Two Michigan State basketball players are accused of committing sexual assault on an unidentified woman for nearly an hour in their dorm room, according to a report in The Michigan Messenger.
Prosecutors have declined to pursue charges, though the paper reports that the victim disputes the reason for not doing so. The players’ names have not been released because there haven’t been charges.

The police report indicates that one of the two players corroborated the victim’s story in his statement to police. Although the MSU Police Department forwarded the report to the prosecutor’s office with a recommendation that the men be charged with Criminal Sexual Conduct 1 — the most serious level of sexual assault under state law — Dunnings has declined to prosecute the case.
In a statement dated Sept. 14 and released on Friday, Dunnings says charging a criminal sexual conduct case “requires the element of force and/or coercion.” He said numerous prosecutors of both genders reviewed the case report and “none could find any of these necessary elements.” The police report and statements by the victim suggest otherwise.
The Messenger’s lengthy story has numerous details on the event, including events that led to, occurred during and after the alleged assault. Most interesting is the back-forth between the alleged victim and the investigating officers and how they decided to not pursue the case.
The school hasn’t released a statement.

I can’t even imagine a case like this not being prosecuted.Then on the other hand–what do I know I am just a dumb hick from French Lick. But borrowing a line from 49′ers coach Mike Singletary,”there is a rat in the house” with the DA not prosecuting this case. Do you think that Tom Izzo has the DA in his backpocket? Even the young lady’s story was corrobrated by one of the participants and they still did nothing. Shocking! Disgusting? Absolute travesty of justice. Had the partcipants been any ordinary citizens, we wouldn’t even be having this dicussion–the perpetrators would have been locked up and headed for a court date. But…Oh Noooooooooooooooo–they are MSU basketball players. Imagine that.

I wonder why the local papers, The Detroit News and The Detroit Free Press have not even mentioned this story? Does NBC know the journalistic background of the Michigan Messenger? Has Mike Miller read the ACTUAL police report? Careful treading here NBC, the lawyers for the Duke Lacrosse Boys are watching closely…..

Sarl. Dennings has it out to GET MSU most of the time. If there was any chance of this being true he would file charges. It’s BS. The girl isnt a victim. She’s a false accuser.
Also, dennings told wlns cbs that there is more to the case that is not in the police report and that will never be made public.

It is Dunnings, not Dennings and he is a grad from UofM Law School who does not cut players slack and is not in Izzo’s pocket and he went further than most prosecutors who normally say “insufficient evidence”, Dunnings said no crime occurred. Dunnings during 2007-2009 was highest in % of CSC complaints charged and 3d another time in the 9 county area around Lansing so he takes these complaints seriously.
