Report: Villanova’s JayVaughn Pinkston accused of violating probation

Back in 2010, Villanova forward JayVaughn Pinkston was involved in an altercation at an off-campus party in which he was accused of assault. After multiple postponements of his case, Pinkston, a first-time offender, was able to get into the Accelerated Rehabilitative Disposition (ARD).

Under the ARD, Pinkston could avoid the criminal justice system, replacing it with community service and restitution. On Friday night, a report from Carl Hessler Jr. of the Times Herald stated that Montgomery County prosecutors are attempted to remove Pinkston from the ARD for allegedly violating the terms of the program. Prosecutors are claiming Pinkston has failed to meet with probation officers, finish his community service and pay fines.

From the Times Herald:

Assistant District Attorney Lindsay O’Brien alleged Pinkston, 23, also has failed to pay $7,445 in restitution and court costs of $3,831 for a total of $11,276, according to court documents.

If a judge revokes Pinkston’s ARD sentence, he could be forced to stand trial on the original charges of simple assault and harassment in connection with his alleged assault of another man during a November 2010 altercation that reportedly involved two other Villanova students at an off-campus party in Upper Merion.


If removed from the program, Pinkston could face trial, where he is charged with simple assault and two counts of summary harassment (which is typically attached to a simple assault charge). Simple assault carries a two-year sentence.

“We’re going to explain to the court that $11,000 in restitution for a college student is not realistic. We’re going to ask the court for more time to pay it and he graduates this year and hopefully he’ll have a professional basketball career with the NBA or somewhere else and then it should not be an issue,” said Pinkston’s attorney James D .Famiglio, who also claims Pinkston’s community service has been completed, but not all of it had not been reported.

Pinkston was suspended for the entire 2010-11 season, needing to be readmitted to the school that summer. He went on to led the Wildcats in scoring during 2012-13 season, and has now led Villanova to back-to-back 26-win seasons.

The sixth-ranked Wildcats take on Xavier in Cincinnati on Saturday afternoon.
